8.1 Disclaimer of Warranties

WE DO NOT WARRANT THAT: (A) THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS; (B) THE RESULTS OF USING THE SITE WILL MEET YOUR REQUIREMENTS; OR (C) PRODUCT DESCRIPTIONS, PRICING, OR OTHER CONTENT ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL

AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY: (A) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES; (B) LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES; (C) PERSONAL INJURY OR PROPERTY DAMAGE NOT DIRECTLY CAUSED BY A DEFECTIVE PRODUCT; OR (D) DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. OUR TOTAL CUMULATIVE LIABILITY TO YOU ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF THE SITE, OR ANY PRODUCT PURCHASED THROUGH THE SITE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU FOR THE PRODUCT(S) DIRECTLY GIVING RISE TO THE CLAIM DURING THE SIX (6)-MONTH PERIOD IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00). Some jurisdictions do not permit the exclusion or limitation of certain warranties or consequential damages. In such jurisdictions, the above limitations will be applied to the maximum extent permitted by applicable law, and our liability will be limited to the minimum amount required by law.

8.3 Product Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded by applicable law. In jurisdictions with mandatory statutory consumer protection rights

(including, without limitation, implied warranties on consumer goods), those rights are not waived or excluded by these Terms.
